Cancellation Policy and Media Waiver

All sales of yoga classes, meditation classes, workshops, merchandise, special events, retreats and experiences, birthday parties, packages, and other services are final. Cancellations must be submitted ONLINE 24 hours before the in-person and Online class/workshop time. Clients may cancel a booked class/workshop 24 hours or more before class time without forfeiting the reservation. If you cancel after this time or are a no-show, your account will be charged for the class/workshop. If canceled early, you may reschedule your appointment within the next 30 days.

PHOTOGRAPHS, VIDEO, AND OTHER DIGITAL MEDIA

I hereby grant SAKU Wellness and The Kids Classes (TKC) permission to use my likeness in a photograph, video, or other digital media (“photo”) in any and all of its publications, including web-based publications, without payment or other consideration.

I understand and agree that all photos will become the property of the SAKU Wellness and The Kids Classes and will not be returned. I hereby irrevocably authorize SAKU Wellness and The Kids Classes to edit, alter, copy, exhibit, publish, or distribute these photos for any lawful purpose. In addition, I waive any right to inspect or approve the finished product wherein my or my children’s likeness appears. Additionally, I and my children waive any right to royalties or other compensation arising or related to the use of the photo.

I hereby hold harmless, release, and forever discharge the SAKU Wellness and The Kids Classes from all claims, demands, and causes of action which I, my heirs, representatives, executors, administrators, or any other persons acting on my behalf or on behalf of my estate have or may have by reason of this authorization.

I have read and understand the above photo release. I affirm that I am at least 18 years of age, or, if I am under 18 years of age, I have obtained the required consent of my parents/legal guardians as evidenced by their signature below.

By signing below I acknowledge and represent that I have read the foregoing Waiver of Liability, understand them, and sign this voluntarily as my own free act and deed, including without limitation the Release of Liability and Indemnification requirements contained in this document; I am sufficiently informed about the risks involved in using SAKU Wellness and The Kids Classes to decide whether to sign this document; no oral representations, statements, or inducements, apart from the foregoing written agreement, have been made; I am at least eighteen (18) years of age and fully competent; and I execute this document for full, adequate, and complete consideration fully intending to be bound by the same. I agree that this Waiver of Liability shall be governed by and construed in accordance with Illinois law, and that if any of the provisions hereof are found to be unenforceable, the remainder shall be enforced as fully as possible and the unenforceable provision(s) shall be deemed modified to the limited extent required to permit enforcement of the Waiver of Liability as a whole.

Waiver of Liability and Indemnification

NOTICE: Before participating in this or any exercise program individuals should consult a physician.

VOLUNTARY PARTICIPATION: I, the undersigned, acknowledge that I have voluntarily chosen and requested to participate in the yoga class, workshop, event, or activity sponsored by SAKU Wellness and The Kids Classes.

ACKNOWLEDGEMENT: I am aware that participation in the yoga class, workshop, event, or activity may be hazardous. I acknowledge that a certain minimum level of physical health, strength, fitness, and flexibility may be required. I represent that I possess the level of health to participate in these activities. I am voluntarily participating in these activities with knowledge of the risks of injury. I assume all responsibility and liability for any and all injuries I may sustain due to my participation in these activities.

RELEASE: In consideration for being permitted to participate in the yoga class, workshop, event or activity, I agree that I, my heirs, assignees, guardians, and legal representatives will not make any claim against, sue, or attach the property of any of the hosts, instructors, organizers, or participants in the yoga class, workshop, event or activity including but not limited to SAKU Wellness and The Kids Classes or injury or damage resulting from my participation. I release all such hosts, instructors, organizers, and participants, their agents and heirs from any and all actions, causes of action, lawsuits, claims, or demands that I, my assignees, heirs, guardians, and legal representatives, now have or hereafter may have for any and all injury, illness, loss of or damage to property associated with my participation in the yoga class, workshop, event, or activity.

I have carefully read this agreement and fully understand its contents. I have signed this release form freely and voluntarily. I am aware and agree that it is a complete release of liability for any injuries or damages that I may sustain due to yoga classes, workshops, events, and activities with SAKU Wellness and The Kids Classes and all such hosts, instructors, organizers, and participants.

COVID-19 WAIVER OF LIABILITY AND INDEMNIFICATION

I agree that I am personally responsible for my safety and actions while using SAKU Wellness and The Kids Classes. I agree to comply with all SAKU Wellness and The Kids Classes policies and rules, including but not limited to all SAKU Wellness and The Kids Classes policies, guidelines, signage, and instructions. Because SAKU Wellness and The Kids Classes is open for use by other individuals, I recognize that I am at higher risk of contracting COVID-19. With full awareness and appreciation of the risks involved, I, for myself, on behalf of my family, spouse, estate, heirs, and personal representatives, hereby forever release, waive, discharge, and covenant not to sue SAKU Wellness or The Kids Classes, its owners, agents, independent contractors, affiliates, employees, successors, and assigns (collectively the “Released Parties”) from any and all liability, claims, demands, actions, and causes of action whatsoever, directly or indirectly arising out of or related to any loss, damage, or injury, including death, that may be sustained by my children or me related to COVID-19 whether caused by the negligence of the Released Parties, any third-party using SAKU Wellness or The Kids Classes or otherwise, while participating in any activity while in, or around SAKU Wellness and The Kids Classes and/or while using any SAKU Wellness or The Kids Classes facilities, tools, equipment, or materials.

I agree to indemnify, defend, and hold harmless the Released Parties from and against any and all costs, expenses, damages, claims, lawsuits, judgments, losses, and/or liabilities (including attorney fees) arising either directly or indirectly from or related to any and all claims made by or against any of the Released Parties due to bodily injury, death, loss of use, monetary loss, or any other injury from or related to my use of the SAKU Wellness and The Kids Classes facilities, tools, equipment, or materials, whether caused by the negligence of the Released Parties or otherwise specifically related to COVID-19.
